This equipment must be installed by licensed personnel in accordance with all applicable regulations. In the case of installations in U.S.-registered aircraft, among other things, FAA form 337 must be filed. An aircraft logbook entry must be recorded per 14 CFR Part 91, sections 91.405 & 91.417.
TRIO PROPILOT CONTROLLER & SERVOS
Trio Avionics warrants its products for a three-year period from the date of first flight of the product. This warranty specifically excludes equipment that has been subject to modification, misuse in its intended application or physical or environmental abuse. Autopilots and servos manufactured by Trio Avionics Corporation under a Federal Aviation Administration PMA issued pursuant to a license from The STC Group LLC are warranted exclusively by Trio Avionics Corporation. There is no warranty from The STC Group LLC on any components of the Trio Avionics Corporation Pro Pilot system other than the installation hardware kit (“installation kit”) manufactured under The STC Group LLC’s design and supplemental type certificate.
Aircraft of the same make and model can have variances not reflected in the logbooks. In most cases, these can be remedied as an adjustment or minor modification within the parameters of the existing Supplemental Type Certificate. In all cases, the purchaser should review the Installation Instructions relevant to the installation kit being purchased to assure that there are no obvious incompatibilities between the installation kit and the target aircraft. This is particularly true (but not limited to) aircraft with any modifications such as STOL kits, float installations, etc. The STC Group LLC will answer general compatibility questions directed to it. In the event a kit is found to be incompatible, Purchaser’s sole and exclusive remedy is a refund of the purchase price upon receipt by The STC Group LLC of an undamaged complete kit in like new condition. Purchaser is solely responsible for return shipping and customs charges, if any. The STC Group LLC will not be responsible for labor charges or loss of use of the aircraft damages as a result of any such incompatibility determination. Installation kits are warranted by The STC Group LLC to be free from defects in materials or workmanship for the earlier of 3 years or 400 flight hours from the date of purchase and 6 months or 200 flight hours for factory repaired or newly-overhauled products exchanged through The STC Group LLC or its authorized PMA vendor. Within the applicable period, The STC Group LLC will, at its sole option, repair or replace any components of the installation kit that fail in normal use. Such repairs or replacement will be made at no charge to the customer for parts or labor incurred in making such repair, provided that the customer shall be responsible for all costs of removing from any aircraft and re-installing the allegedly defective installation kit in any aircraft and all shipping, packaging, handling or transportation cost. This warranty does not apply to: (i) cosmetic damage, such as scratches, nicks and dents; (ii) consumable parts, such as batteries, unless product damage has occurred due to a defect in materials or workmanship; (iii) damage caused by accident, abuse, misuse, water, flood, fire, or other acts of nature or external causes; (iv) damage caused by service performed by anyone who is not authorized by The STC Group LLC to be a service provider; (v) damage to a product that has been modified or altered without the written permission of The STC Group LLC, or (vi) alleged failure of the autopilots and/or servos to perform any function not specifically authorized in the Instructions for Continued Airworthiness (ICAW) provided with the STC.
The STC Group LLC reserves the right to refuse warranty claims against products that have been installed or used in contravention of any terms set out in the relevant Supplemental Type Certificate or in The STC Group LLC’s Installation Instructions or Instructions for Continued Airworthiness. (ICAW). The STC Group LLC reserves the right to refuse warranty claims against products or services that are obtained and/or used in contravention of the laws of any country.
EXCLUSIVE LIMITED WARRANTY – NO CONSEQUENTIAL DAMAGES THE WARRANTIES AND REMEDIES CONTAINED HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY LIABILITY ARISING UNDER ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, STATUTORY OR OTHERWISE. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, WHICH MAY VARY FROM JURISDICTION TO JURISDICTION. IN NO EVENT SHALL THE STC GROUP LLC BE LIABLE IN A CLAIM FOR BREACH OF WARRANTY FOR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES, WHETHER RESULTING FROM THE USE, MISUSE OR INABILITY TO USE THE PRODUCT OR FROM DEFECTS IN THE PRODUCT. AMONG OTHER THINGS, THE STC GROUP LLC WILL NOT UNDER ANY CIRCUMSTANCE BE LIABLE FOR LABOR OR EXPENSES ADJUSTING OR MODIFYING AN AUTOPILOT OR INSTALLATION KIT TO ADAPT TO A GIVEN AIRCRAFT, OR FOR LOSS OF USE OF ANY AIRCRAFT DUE TO AN ALLEGED DEFECT OR FAILURE OF ANY COMPONENT COVERED BY THIS LIMITED WARRANTY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES. THIS LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES WILL BE APPLICABLE TO THE EXTENT PERMITTED BY RELEVANT LAW.
ON-LINE AUCTION PURCHASES
Online auction purchases: Products purchased through online auctions are not eligible for warranty coverage. Online auction confirmations are not accepted for warranty verification. To obtain warranty service, an original or copy of the sales receipt from a retailer authorized to sell installation kits manufactured pursuant to a license from The STC Group LLC is required. The STC Group LLC will not replace missing components from any package purchased through an online auction.
The STC Group LLC retains the exclusive right to repair or replace (with a new or newly-overhauled replacement installation kit) the product or offer a full refund of the purchase price at its sole discretion. SUCH REMEDY SHALL BE YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY BREACH OF WARRANTY.
Before returning any Trio Avionics product we recommend Trio Avionics be contacted to discuss the reason for the return. It is often the case that a simple configuration setting or a clarification of the equipment operation can resolve the problem. In the event the product must be returned, please include a concise description of the problem along with your contact information including your phone number and email address. Please confirm the Trio Avionics shipping address during your phone contact.
Items that are in need of immediate repair and quick turnaround should be marked “HOT” in bold lettering in several places on the package exterior. Trio Avionics will make every effort to expedite repair on items so marked.
Currently, Trio Avionics charges a flat rate repair fee of $150 plus shipping. Items that have been subjected to modification, misuse in its intended application or physical or environmental abuse will be evaluated and the customer advised of the estimated repair cost prior to completion of the repair. Repaired items returned within the warranty period that exclude such misuse shall be at no charge with the exception of shipping.
Installation kits manufactured pursuant to a license from The STC Group LLC for installation in a certificated aircraft require an authorized person to return the aircraft to service after product repair.
Repairs not governed by the foregoing limited warranty will be performed by THE STC Group LLC or its designated PMA manufacturer under then-prevailing billing rates.
Irrespective of warranty status, all shipping charges, brokerage fees, taxes or other charges related to the shipment are the responsibility of the customer.
International shipments will be sent using the carrier designated by the customer, but limited to the US Postal service, UPS, FEDEX or DHL. It is recommended that efforts to ship to a US destination for eventual international arrival be a priority rather than direct shipment to an international destination, if at all possible.
All international shipments will be shipped in accordance with all applicable customs requirements and laws.
Fielded equipment is designed to be upgraded with new features and capabilities as these become available. Pricing on upgraded systems will be determined and applied as the upgrades become available.
All claims of any type involving the foregoing limited warranty or any other dispute involving installation kits manufactured for installation in certificated aircraft under a PMAA issued pursuant to a license from The STC Group LLC will be subject to mandatory arbitration under the substantive law of the State of California in Ventura County, California. Purchaser and The STC Group LLC waive any right to have any dispute or controversy involving covered by this section resolved in any other forum. Purchaser and The STC Group LLC expressly waive any right to trial by jury. Trio Avionics Corporation is an express third-party beneficiary of this agreement and will have standing to require arbitration and to enforce the waiver herein of trial by jury.
Arbitration will be conducted under the Streamlined Arbitration Rules and Procedures of the Judicial Arbitration and Mediation Service (“JAMS”) in effect on the date this agreement is signed. These rules are posted on the JAMS website at this address http://www.jamsadr.com/rules-streamlined-arbitration. Any conflict between such rules and the requirements of due process under the substantive law governing the underlying dispute shall be resolved by conforming the JAMS rules to comply with the requirements of the governing local law, provided however, that such local law shall not be construed to invalidate or nullify this agreement to arbitrate the validity of which shall be construed in accordance with the United States Arbitration Act; 9 U.S. Code section 025 et seq.
In all disputes between Purchaser and The STC Group LLC or Purchaser and Trio Avionics Corporation, each shall bear his/her/its own attorney fees and costs, including that party’s share of the arbitration costs and fees.
